Family court property valuation — scales of justice

About This Purpose

What Is Property Valuation for Family Court?

A family court property valuation is an independent assessment of a property's market value, required during divorce or separation proceedings for the purpose of property settlement. The Family Court of Australia and Federal Circuit and Family Court require accurate, unbiased property valuations to ensure fair division of matrimonial assets.

Family court valuations must be prepared by a qualified, independent valuer who can demonstrate impartiality and adherence to recognised professional standards. At Landmark Valuations, our family court valuations are prepared in accordance with RICS Red Book Global Standards 2025 and comply with the Expert Witness Code of Conduct under the Family Law Rules. Our valuers are experienced in providing Single Expert Witness valuations where both parties agree to use one independent valuer.

The valuation considers factors including the property's condition, location, comparable sales evidence, improvements, and any encumbrances or special circumstances that may affect value. Our reports are prepared to court-admissible standards and include detailed methodology, supporting evidence, and clear reasoning for all value conclusions, ensuring they withstand cross-examination and judicial scrutiny.

Next Steps

What happens after the valuation?

Once the valuation is completed, the report is submitted as evidence in Family Court proceedings. It forms the basis for property settlement negotiations between the parties or, if agreement cannot be reached, for court-ordered division of assets.

RICS-compliant valuations carry significant weight with the Family Court due to the rigorous methodology, independence requirements, and professional standards they adhere to. If our valuer was appointed as a Single Expert Witness, the court will typically rely on the report as the primary evidence of property value.

In cases where negotiations proceed outside court, the valuation provides an objective and authoritative reference point that helps both parties reach a fair settlement. Our valuers can also attend court to provide expert testimony if required, and are experienced in presenting evidence and responding to cross-examination in family law proceedings.
